Five EPR myths on Amazon

Amazon sellers are subject to the EPR regulations. What does that mean? EPR stands for "extended producer responsibility". However, there are still some ambiguities and sometimes even myths regarding the new regulations. Therefore, we would first like to explain in general what the EPR means for Amazon Sellers. What does the EPR mean for Amazon Sellers?

Amazon sellers have already been informed by mail that they must provide a registration number because of the EPR. In addition, Amazon has pointed to various EPR help pages that sellers can use to obtain information on the topic. In concrete terms, extended producer responsibility means that producers are responsible for the entire life cycle of a product. This includes, above all, environmental impact. The regulations apply to Amazon sellers who manufacture, import or sell a product. Accordingly, they are required to provide an EPR registration number or apply for one. In Germany, the EPR regulations apply to these Amazon products: Packaging, Electrical and Electronic Equipment, and Batteries. So you need to note that a registration has been made, that you provide a declaration and reporting, and that you pay the appropriate fees. Where do the EPR laws apply?

Amazon only requires an EPR registration number for the marketplaces in Germany and France. As a result, some people are under the misconception that the laws only apply in these two countries. However, this is not the case, because in other countries there is simply no control obligation. EPR laws apply accordingly in all EU countries as well as the United Kingdom, Norway and Switzerland as well. Since when do the EPR rules apply?

EPR rules have not just been in place since 2022, but marketplace providers like Amazon have only been required to monitor compliance since July 1, 2022. In general, however, the rules have been in place since the 1990s. They are based on the EU Packaging Directive of 1994.

Is the registration enough?

Some sellers still believe that registration is enough to comply with EPR laws. However, mere registration for EPR is not enough for Amazon. Packaging must also be licensed. Help regarding licensing is also available at ecosistant.

Do the EPRs only apply to packaging?

No, as mentioned above, the EPRs also apply to batteries and electronic devices, for example. From 2023, Amazon will also check the WEEE Reg. No. and the Batt Reg. No. The verification of both numbers can take several weeks. Accordingly, you should act as early as possible so that you do not have to lose sales.

Are the EPRs controlled at all?

Yes, the EPRs are controlled by the EU's Market Surveillance Regulation, for example. In addition, authorities in European countries cooperate to control compliance with the law. Therefore, always make sure that you have a registration number, report and pay the necessary fees.
